Terms of Service

Your account

You must be at least 16 years old to use Markowill. Keep your login credentials confidential, give us accurate account information, and tell us promptly if you believe someone else has accessed your account. You are responsible for activity that happens under it.

Organizations and team members

Markowill is organized around organizations and the entities inside them. If you join an organization, an administrator of that organization can manage its members, see the workspace content stored in it, and control its settings, including which AI provider it uses. Content you create inside an organization belongs to that organization, not to your personal account.

Subscriptions, billing and renewal

• Paid plans are billed in advance through Stripe. The price and the billing period are shown before you confirm, at checkout.
• Subscriptions renew automatically at the end of each billing period, at the then-current price for your plan, until you cancel.
• Stripe emails a receipt for every payment. Your current plan and renewal date are always visible in Settings → Account.
• If a payment fails we may retry it and, if it keeps failing, suspend or cancel the subscription. We will tell you before access is removed.
• We may change our prices. A change never applies to a period you have already paid for, and we will give you notice before it takes effect so you can cancel if you do not want to continue.

Cancelling

You can cancel at any time, yourself, from inside the app: go to Settings → Account and open Manage billing. Cancelling takes no more steps than subscribing did, and does not require you to contact us or send an email.

When you cancel, your subscription stays active until the end of the period you have already paid for, and then stops renewing. We do not delete your workspace when a subscription ends; to remove your data, use the deletion process described in our Privacy Policy.

Free trials

Where we offer a free trial, the length and the terms are stated when you start it. Unless we say otherwise, a trial converts into a paid subscription when it ends, so cancel before the trial finishes if you do not want to be charged. We may limit trials to one per customer.

Refunds

Payments are generally non-refundable, except where a refund is required by the law that applies to you or where we have clearly got something wrong. If you think a charge is a mistake, write to us at contact@markyagent.com and we will look at it in good faith.

Your content

You keep ownership of everything you put into Markowill. You grant us the permission we need to host, store, process and transmit that content in order to run the service for you, including sending the parts required to fulfil a request to the AI and integration providers listed in our Privacy Policy. That permission exists only to operate Markowill and ends when you delete the content or your account.

You are responsible for having the rights to the content you upload and for making sure that what you send through Markowill, including marketing emails and social posts, complies with the law and with the rules of the platform it is published to.

AI-generated output

Markowill writes drafts, captions, images and other content with the help of AI models. That output can be wrong, out of date, or unintentionally similar to something else. Review it before you publish or send it. You remain responsible for anything published from your account, including content Markowill drafted and content published on a schedule you approved.

Markowill is a marketing tool. Its output is not legal, financial, medical or other professional advice. Do not use Markowill to generate content that is unlawful, that impersonates a real person or organization, or that presents invented figures, reviews or testimonials as though they were real.

Acceptable use

You agree not to:

• use Markowill to send unsolicited bulk email, or to contact people who have not given you a lawful basis to contact them;
• upload malware, attempt to access other customers' data, probe or circumvent our security, or interfere with the service;
• resell or provide Markowill to a third party as your own service, or use it to build a competing product;
• use Markowill in a way that breaks the terms of a platform you have connected, such as LinkedIn, Buffer, Google or Mailchimp; or
• use Markowill for anything unlawful, deceptive, harassing or infringing.

Connected services

Markowill can connect to third-party services on your instruction. Those services are run by other companies under their own terms, we do not control them, and we are not responsible for what they do or for changes they make to their APIs. If a connection stops working because a provider changed or withdrew its service, that is not a failure of Markowill under these terms.

Availability and changes

We work to keep Markowill available and improve it, which means features can change, be added, or be withdrawn. We do not promise uninterrupted service: maintenance, provider outages and faults happen. If we make a change that materially reduces a paid feature you rely on, we will give you notice.

Suspension and termination

You can stop using Markowill and delete your account at any time. We may suspend or end your access if you materially break these terms, if your use puts the service or other customers at risk, or if we are required to by law. Except where the breach is serious or unlawful, we will give you a chance to put it right first.

Disclaimers and liability

Markowill is provided as it is. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, lost revenue, or loss of data or goodwill. To the extent the law allows, our total liability to you for any claim relating to Markowill is limited to the amount you paid us in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your mandatory legal rights are not affected.

Changes to these terms

We may update these terms. We will post the new version on this page and update the effective date, and for material changes we will give you notice before they take effect. Continuing to use Markowill after that means you accept the updated terms.

Governing law

These terms are governed by the laws of France, and disputes will be handled by its courts. If you are a consumer resident elsewhere, you keep the protection of the mandatory laws of your country of residence.
